The Build America, Buy America Act (BABA) was enacted in 2021 as part of the Infrastructure Investment and Jobs Act (IIJA). It establishes a domestic content procurement preference for all federal financial assistance (FFA) used to finance infrastructure projects, including real estate. Up until August 23, 2024, HUD held a phased implementation waiver for the Build America, Buy America Act (BABA) but that waiver has since ended.
Are members of this group seeing impacts on their housing construction project schedules and costs as a result of compliance with BABA? Have any members been through the waiver process for any of their individual projects?
