  • 1.  Basic Services Fee and Responsibility

    I have provided a proposal to an owner for design development and construction documents and they agree to my fee.  My proposal includes construction administration and other Basic Services that are included in the AIA B151 but I intent to provide these only as an hourly or additional fixed fee if requested by the owner and agreed to by the architect and owner.  The owner now would like for me to sign the B151 that includes a detailed description of Basic Services.  Am I not responsible to provide Basic Services beyond Design Development and Construction Documents if 11.2.1 Basic Compensation notes "design development and construction documents shall be provided as a basic service for a stipulated sum of $xxxx.xx"?

    We do that all the time. Describuing the scope of services under Basic Services does not need to mean that they are provided for a fixed fee. They can be provided under another arrangement, using the same contract.
    All you need to do is modify the clause regarding the fixed fee to apply to the phases intended, and then add the phrase "construction Administration" or whatever else is being provided on an hourly basis to the clause which describes charges for "Additional services"
